During the last parliamentary elections, Pakatan Harapan had promised an increase from 5% of oil and gas royalties to 20% be returned to Sarawak. There was a promise of 50% return of all revenues collected from the State.
The promise was made in serious tones repeatedly by many leaders of PH. Chong Jr ( CCJ) also made the promise in the Sarawak Legislature... "a promise, black and white,..no need to beg as long as PH forms the federal government.
These promises also appeared in PH Elections Manifesto. Now, such promises had not been fulfilled. I remember, PH promised to fulfil the manifesto within 100 days of taking office. If this is correct, then by not fulfilling the manifesto with the 100 days period, it could be argued that the PH government should be held liable under the rule of Carlill v Carbolic Smoke Ball case.
PH government and leaders who spoke on promise could also be liable for political negligence or political misrepresentation or tort of deception. There is a recent case in UK in which politicians were sued based on unfulfilled promise during election campaign.
Therefore, if you are invited to speak in public forums or are asked to speak for the party, you are to speak on politics and political issues only and never to make promises to public
