Welcome To Voice Of Kenyalang

This website is established by a group of concern Sarawakian with the aim to provide latest news of Sarawak. Learning from the past and charting new path for the future. Sabah and Sarawak people main concern is the restoration of Malaysia Agreement 1963 (MA63) which had been properly registered at United Nation (UN), and MA63 is the foundation of formation of Malaysia. During formation of Malaysia, Sabah, Sarawak and Malaya are equal partners therefore any ACTS, laws, regulation and policies passed in parliament (with the intention to restrict or nullify full function of Malaysia Agreement 1963)  are illegal and therefore are against the very foundation of formation of Malaysia at the disadvantage of Sarawak and Sabah with the intention to remove equal partners status of Sarawak and Sabah making Sabah and Sarawak one of the states in Malaysia.

SUPP is a component party of GPS and GPS had many times made it clear that they are only seeking autonomy or autonomous rights of certain matters and not independence from the federation of Malaysia. By declaring to seek autonomy, shows GPS will not wish Sarawak to leave Malaysia.

Therefore, SUPP is a "Sandwich Party", sandwiched between choosing fighting for autonomy on behalf of GPS and independence spearhead by Parti Bumi Kenyalang.

The call by SUPP outside and inside the Sarawak Parliament in urging the Federal government to allow Sarawak to hold a referendum on whether Sarawakians would opt to stay or to leave Malaysia is a strategy by SUPP to divert the attention of the public concerning the stand taken by GPS to stay in the federation of Malaysia. The stand to seek independence by SUPP being not endorsed by the Chief Minister, Abg Joe, who is the head of GPS, is not binding on GPS but rhetoric to capture votes to win the coming Sarawak elections.

There is no declaration from SUPP that they disagree with fighting for autonomy but is fighting for independence of Sarawak as voiced by Parti Bumi Kenyalang. Therefore, the public should be informed Parti Bumi Kenyalang cannot work with SUPP on this issue.

The issue on independence and strategies on how to seek independence proposed by Parti Bumi Kenyalang has in past months, caught the eyes of urban and semi-urban voters and assessments made is that voters in urban and semi-urban areas favour independence and favour the strategies put forward by Parti Bumi Kenyalang on how to set Sarawak free and be independent. The President of the Party had also been interviewed by foreign correspondents on this issue. A foreign law professor emeritus had also came forward to give his legal opinion on how Sarawak could gain freedom and independence under international law.

Public opinion is that GPS is under pressure and has to rely on SUPP to counter the independence issue put forward by Parti Bumi Kenyalang.

The public is advised that seeking autonomy on Sarawak rights from the federation of Malaysia is different from seeking independence. Even if full autonomy over a matter is allowed, this does not mean Sarawak could be free from political, social, economic, cultural and religious domination by Malaya.

Legally and politically, nothing can prevent the federal government or Malaya to take back rights that had been given away.

Public has to be informed that if SUPP is serious or wants Sarawak to be free and independent, SUPP should have moved a Motion in the Sarawak Parliament, seeking support from members of the Sarawak Parliament, to get the federal government to pass a Referendum Act to allow Sarawakians to determine the fate of Sarawak, but, this had not been done at all. If a Motion is tabled, this will give the public to know who among the YBs in Legislature who are for or against independence.

SUPP is trying to put itself in the limelight by indicating that independence could only be achieved by way of a referendum. This could be misleading.

The public is being informed herewith that there is no legal provision under Malaysian Law or under the Malaysian Constitution to say that a referendum is necessary to determine whether or how to exit from Malaysia. When there is no need for a referendum for exit, why should SUPP be a busy body or bothered to gain freedom and independence by way of a referendum?

Even if the federal government may consider a referendum law to be passed, this can take many years to have the law passed. Perhaps, the people of Sarawak will wait for 20-30 years for this referendum law to become a reality. Perhaps we may only get the referendum law passed after all oil and gas resources dried up and our prime land been taken by those who are in power. Even passed, there will be no guarantee a referendum be held.

Sarawakians may need to know that international law also never say in a situation Sarawak is in, a referendum is a necessary legal requirement for a suppressed Sarawak with economic and political differences with the federation of Malaya, who wants to be free and independent, to hold a referendum.

Again, unless there is a prohibition to secede or exit, Sarawak can chose to secede or exit without a referendum to be held- see Kosovo case.

Kosovo unilaterally declared independence from Serbia in 2008 and International Court of Justice (ICJ) advised that what was done by Kosovo was valid under international law. Kosovo then became a nation, free and independent from Serbia.

If we read carefully the declaration of independence of Singapore by Mr. Lee Kuan Yew in 1965, it was a unilateral declaration of independence.

This Malaysian Constitution is still the same Constitution which made Singapore as part of Malaysia. There was no mention in the Constitution of the need of a referendum for Singapore to decide whether to opt to stay or exit from the federation of Malaysia. At the same time, there is also no provision to say the federal government or federal Parliament could kick Singapore out of the federation.

Tunku claimed Singapore was kicked out. This is beside the point. The point is, there was no referendum by Singapore to exit from Malaysia as unilaterally declared by Lee Kuan Yew.

Although referendum is a strategy that could be applied to secure freedom and independence, but, if unilateral declaration of independence by Kosovo and Singapore are legal and had been proven as an effective strategy, why not use it?

Parti Bumi Kenyalang will therefore, in its quest of independence, focus on unilateral declaration of independence and by seeking independence through domestic and international court, while not losing sight of referendum as a strategy to gain freedom and independence for Sarawak. Parti Bumi Kenyalang will always keep referendum strategy an option to gain freedom and independence for Sarawak.

DUN can declare exit from Malaysia after certain legal procedures as required by domestic and international law.
