Deputy Prime Minister II Datuk Seri Fadillah Yusof was tasked by the primer minister Dato Seri Anwar Ibrahim in December 2022 the responsibility of resolving outstanding issues concerning the Malaysia Agreement 1963 (MA63). It is not difficult to resolve this matter.
Fadillah Yusuf informed the public the Sarawak government has no intention to bring matters to court.
Parti Bumi Kenyalang says the more suitable avenue is to file a Bill to dissolve MA63 in Parliament.
Fadillah Yusuf should be able to understand that the purpose of MA63 was the subjugation of Sarawak and Sabah in the hands of Malaya.
The intentions of the Treaty was to take the oil and gas resources and vast lands of Sarawak and Sabah to enlarge Malaya.
Therefore, Malaya did not come with clean hands. Malaya then notified the United Nations Secretariat that Malaya took a new name "Malaysia". Therefore , Malaysia is not a new nation, but an enlarged Malaya.
It is clear therefore, Malaya was not acting in good faith towards Sarawak and Sabah, which was promised equal and fairness in the federation.
Therefore, the Treaty was in fact seen by nationalists and activists as a "scam" to make Sarawak and Sabah as colonies of Malaya, or at least to be treated as colonies of Malaya.
This makes the Treaty invalid and nothing in the treaty should or could be enforced or negotiated.
To allow negotiations or to enforce an invalid Treaty would be seen by the Sarawakian and Sabahan public as betrayals of their rights to see no wrongs or illegalities should be put to right or be "legalised".
Based on the Chagos Islands Case delivered by the International Court of Justice (ICJ), which advised that no treaties made by colonies with parent countries are valid, Fadillah Yusuf, should get parliament to dissolve this MA63 and to set Sarawak and Sabah free and independent first and then let Borneo people to decide their own destinies and destinies of their countries, Sabah and Sarawak.
Sabahans and Sarawakians have intrinsic rights to decide whether they wish to continue to "sleep" together with Malaya or go on separate ways.
The advice of Lord Landsdowne, the Chairman of the Inter Governmental Committee ( IGC) was clear on this before Malaysia came into existence. Tunku also echoed the same advice.
The ball is at Fadillah Yusuf's feet and he should not drag the matter anymore.
